BASIC PROVISIONS

1.1. The controller of personal data pursuant to Article 4(7) of the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) is FF Factory s.r.o., ID 07897782, with its registered office at Rozdělovská 2370/55, 169 00, Prague 6, registered with the Municipal Court in Prague (hereinafter referred to as the “controller”).

1.3. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

1.4. The controller has not appointed a data protection officer.

SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA

2.1. The controller processes personal data that you have provided to him/her or personal data obtained by the controller based on the performance of your order:

name and surname
email
mailing address
phone number
2.2. The controller processes your identification and contact details and data necessary for the performance of the contract.

LEGAL BASIS AND PURPOSE OF PROCESSING PERSONAL DATA

3.1. The legal basis for the processing of personal data is:

the performance of a contract between you and the controller pursuant to Article 6(1)(b) of the GDPR,
the fulfillment of a legal obligation of the controller pursuant to Article 6(1)(c) of the GDPR,
the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,
your consent to processing for the purposes of direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on certain information society services if there has been no order for goods or services.
3.2. The purpose of processing personal data is:

the processing of your order and the performance of rights and obligations arising from the contractual relationship between you and the controller; when ordering, personal data necessary for successful order processing (name and address, contact) are required, the provision of personal data is a necessary requirement for the conclusion and performance of the contract by the controller, without the provision of personal data, the contract cannot be concluded or performed by the controller,
the fulfillment of legal obligations towards the state,
sending commercial communications and conducting other marketing activities.
3.3. The controller does not engage in automated individual decision-making within the meaning of Article 22 of the GDPR.

DATA RETENTION PERIOD

4.1. The controller retains personal data for:

the period necessary for the performance of rights and obligations arising from the contractual relationship between you and the controller and the assertion of claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
the period until consent to the processing of personal data for marketing purposes is revoked, for a maximum of 10 years, if personal data is processed based on consent.
4.2. After the expiration of the retention period of personal data, the controller deletes the personal data.

RECIPIENTS OF PERSONAL DATA (SUBCONTRACTORS OF THE CONTROLLER)

5.1. Recipients of personal data are persons:

involved in the delivery of services/payments based on a contract,
providing marketing services.
5.2. The controller intends to transfer personal data to a third country (to a country outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing services.

6.1. The processing of personal data is carried out by the controller, but personal data may also be processed by these processors:

Mailchimp service provider
Google Analytics service provider
Sklik.cz service provider
Google Ads service provider

YOUR RIGHTS

7.1. Under the conditions set out in the GDPR, you have:

the right to access your personal data pursuant to Article 15 of the GDPR,
the right to rectify personal data pursuant to Article 16 of the GDPR or to restrict processing pursuant to Article 18 of the GDPR,
the right to erasure of personal data pursuant to Article 17 of the GDPR,
the right to object to processing pursuant to Article 21 of the GDPR,
the right to data portability pursuant to Article 20 of the GDPR, and
the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms.
7.2. Furthermore, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or you can contact the court.

CONDITIONS FOR SECURING PERSONAL DATA

8.1. The controller declares that he/she has taken all appropriate technical and organizational measures to secure personal data.

8.2. The controller has taken technical measures to secure data repositories and repositories of personal data in paper form, especially by encrypting the database.

8.3. The controller declares that only persons authorized by him/her have access to personal data.

FINAL PROVISIONS

9.1. By submitting an order through the online order form, you confirm that you have read and accept the terms of personal data protection in their entirety.

9.3. The controller is entitled to change these terms. The new version of the personal data protection terms will be published on its website and will also be sent to you by email at the email address you provided to the controller.

These terms shall become effective as of January 1, 2024.
